Speaking Point: 1) After almost seven (7) years of marriage, Heidi Klum (Model and "Project Runway" star) filed for divorce from Seal (Grammy-winning soul and R&B singer) citing "irreconcilable differences."

Speaking Point: 2) Under California Family Code §2310(a), the dissolution of marriage may be based on "irreconcilable differences, which have caused the irremediable breakdown of the marriage." Essentially, this means that there is such incompatibility of the couple that marriage life is no longer possible.

Speaking Point: 3) Seal filed a response to Heidi's divorce action claiming there are "community and quasi-community assets and obligations of the parties, the exact nature and extent of which are unknown to respondent at this time." Under California law, community means 50/50 (half), so, Seal's filing could signal "let the games (divorce) begin!"

Speaking Point: 4) While both Heidi and Seal seek denial of spousal support, presumably, the main point of contention will be the division of Heidi's and Seal's assets. This division of assets is fueled by an alleged post-nuptial agreement that separates assets after marriage.

Speaking Point: 5) Post-nups are valid under California Family Code Part 5, Chapter 1, §1500 which states "The property rights of husband and wife prescribed by the statute may be altered by a premarital agreement or other marital property agreement."

Speaking Point: 6) Pursuant to the their alleged post-nup coupled with Seal's filing response, the focus on the divorce proceeding will most likely concern the classification of community property versus separate property. Obviously, with the couple's estimated high net worth, there is a lot of money at stake.

Speaking Point: 7) The other issue in their divorce filing is that while Heidi requests joint legal custody (with visitation for Seal) of their four kids, Seal seeks joint physical custody. However, generally, courts will side with the children's mother. And, the joint physical custody is probably procedural on Seal's part since he often travels (due to his singing career).
